We are Memorygram. We built this company to help families preserve their most important memories. We understand that your stories, photos, and voice recordings are personal and precious.
We make this promise to you:
Your memories are yours, not ours. We will not use your stories, photos, or recordings for marketing or any other purpose without your express written permission.
We do not sell your memories or the personal content you upload to us.
Like most online businesses, we use standard web advertising technologies (like cookies and pixels) on our website so families can discover Memorygram. We describe these below and explain how you can opt out.
1. Introduction
Memorygram, Inc. ("Memorygram," "we," "our," or "us") respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy describes how we collect, use, and share personal information through our services, including:

By using any of our products or services, you agree to the practices described in this Privacy Policy.
2. Information We Collect
A. Information You Provide
This is information you type in or upload:
Name, email, and phone number
Mobile phone number, if you choose to sign up for our text message program through a signup form or popup on our website, at checkout, or elsewhere
Billing and shipping address
Payment information (This is processed securely by Stripe or PayPal. We never see or store your full credit card number.)
Your stories, photos, and audio recordings
Recordings of a person's voice, and images of a fingerprint, heartbeat, or soundwave, when you provide them for a product that uses them. See Section 7.
Information about other people that you choose to include, such as details about a person being remembered or honored
FamilyDial recipient details (names, phone numbers)
B. Information Collected Automatically
We automatically collect certain information when you use our services:
IP address (to know what country you're in)
Browser type (e.g., Chrome, Safari) and device type (e.g., iPhone, laptop)
Pages viewed, links clicked, and actions taken on our website (like adding a product to cart or starting checkout)
Whether you opened, clicked, or replied to an email or text message we sent you, so we can measure whether our messages are useful and stop sending messages you don't want
This helps us make sure the website works correctly, measure how our marketing is performing, and improve the experience for our customers.
3. How We Use Your Information
We use your information to run our business and provide your products. This includes:
Creating and shipping your book or medallion
Making your FamilyDial calls and texts work
Sending you order confirmations and shipping updates by email and, if you have opted in, by text message
Sending you promotional text messages, such as offers and cart reminders, if and only if you have opted in to our text message program
Processing your payment
Fixing problems with our service, preventing fraud and abuse, and enforcing our terms
Establishing, exercising, or defending legal claims
Complying with legal or tax requirements
Marketing and advertising, meaning measuring the performance of our ads and reaching potential customers on platforms such as Facebook, Instagram, Google, TikTok, and other advertising and analytics services we may use from time to time. This activity uses website analytics data and hashed identifiers only. It does not involve your uploaded stories, photos, or audio.
4. Legal Basis for Processing (If Applicable)
If you are in the European Union, we process your data to fulfill our contract with you (your order), based on our legitimate business interests, to comply with the law, or with your consent (for example, when you opt in to marketing messages).
5. Sharing of Information
We do not sell or rent your memories or the personal content you upload to us. We share limited data with trusted third parties for the following specific purposes:
A. Essential Service Providers
Stripe and PayPal: To securely process your payments.
Our secure hosting partners, who store the website data.
Our SMS and calling providers: To deliver FamilyDial calls and texts and our own text messages.
Klaviyo: To manage our email and SMS lists and to send our email and text messages. Klaviyo processes this information on our behalf under a contract and is not permitted to use it for its own purposes.
Our printing, engraving, and fulfillment partners: To manufacture and ship your physical products. We share only what they need to produce and deliver your order, such as your shipping address and the content that appears in or on your product.
B. Shopify Platform
We use Shopify to run our online store. We share your order information with them so they can process the order and help us with their service.
C. Our Professional AI Tools
We use artificial intelligence to provide several features, including transcribing your audio recordings, converting written stories into audio, and helping you draft or organize written content such as obituaries and memoir chapters.
We want to be very clear about this: We do not use the free, public versions of these tools. We pay for enterprise-level business accounts with our AI partners (such as OpenAI and ElevenLabs, among others we may use from time to time).
These business accounts are governed by contracts that prohibit our partners from using your personal stories, photos, or voice files to train their AI models. Your content is used only to create your product and provide the features you asked for. It is not used by them for any other purpose.
When you ask us to create audio in a specific voice, we may generate a voice model from the recording you provide. Where we do, that model is stored securely with our AI partner so we can produce additional audio for your product. It is used only for your account. You can ask us to delete it at any time by emailing hello@memorygram.com, and we delete it when you delete your account.
Where we help you draft written content, the result is a starting point for you to review and edit. AI-generated text can contain errors, including factual errors. Please review anything we help you write before it is printed or published, because your finished product is permanent. You are responsible for the final content you approve.
D. Advertising Partners
To help potential customers find Memorygram and to measure how our advertising is performing, we share limited website activity data with advertising and analytics platforms. These currently include Meta (Facebook and Instagram), Google Ads, TikTok, Snapchat, and AppLovin, and may include other advertising and analytics partners we work with from time to time. The information shared typically includes:
Pages you viewed on our website
Actions you took (such as adding an item to cart or completing a purchase)
Hashed (encrypted) versions of identifiers like your email address, used by these platforms to match your activity to ad performance
We do not share your uploaded stories, audio recordings, photos, biometric information, or FamilyDial content with any advertising partner.
We do not share your mobile phone number, or your consent to receive text messages, with any third party for that third party's own marketing purposes. Mobile information is shared only with the service providers described in Section 5A who help us operate our text message program on our behalf, and even then it is not shared or sold for their independent marketing.
Under certain state privacy laws (including those in California, Texas, Colorado, Connecticut, and Virginia), our website advertising activity may be considered "sharing for targeted advertising" or a "sale" of personal information. You can opt out. See Section 12.
E. Legal Needs
We may disclose information if required by law, subpoena, or court order, or where we believe disclosure is reasonably necessary to protect our rights, enforce our terms, prevent fraud or abuse, or protect the safety of any person.
F. Business Transfers
If Memorygram is involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction. We will require any successor to honor the commitments in this Privacy Policy with respect to your content.
6. Your Content and Your Ownership (This is important)
You retain full ownership of the stories, audio recordings, images, and other personal content you submit to Memorygram ("User Content").
By submitting User Content, you give us permission only to use that content to create your product and provide your service.
We want to be perfectly clear:
We will not use your stories, audio, or images in our marketing or advertising unless we ask and you give us specific written consent.
We will not publish your content publicly.
We will not share your content with anyone not directly involved in making your product or providing the features you requested.
Your content is yours. Our job is to protect it.
Content You Choose to Publish
Some of our services, including our obituary builder, are designed to create content that you can share publicly or that is accessible to anyone with a link or a QR code. When you choose to publish or share content this way, it may be viewed, saved, or copied by others, and we cannot control what they do with it. Please consider carefully what you include.
Your Responsibilities
When you submit User Content, you confirm that you have the right to do so. This includes content about or created by other people, including people who have passed away. You are responsible for obtaining any permission needed from the people involved or from those with authority to act on their behalf. We rely on that confirmation when we create your product.
7. Voice, Fingerprint, and Similar Personal Characteristics
Some of our products involve recordings of a person's voice, or images of a fingerprint, heartbeat, or soundwave used for engraving or playback. Some laws treat this kind of information as biometric information and give it special protection.
Why we collect it. We collect this information only when you provide it to us for a specific product, and we use it only to create that product and to operate the features you asked for, such as QR code playback or audio in a chosen voice.
What we do not do with it. We do not use this information to identify anyone. We do not use it for advertising or profiling. We do not sell it, and we do not share it with advertising partners. We share it only with the service providers and AI partners described in Section 5 who help us produce your product, under contracts that limit them to that purpose.
How long we keep it. We keep this information for as long as your account is active, so that the QR codes and audio features in your physical products continue to work. We delete it when you delete your account, or sooner if you ask us to remove it by emailing hello@memorygram.com. Deleting this information may disable playback features in products you have already received.
Your confirmation. When you provide a recording or image of another person, including a person who has passed away, you confirm that you have the right to provide it to us for this purpose and to authorize the uses described here.
8. Text Message (SMS) Communications
We offer two kinds of text messages. Both are described here. Our text message program is also governed by our Mobile Terms of Service, available at https://memorygram-thkxiy.myklpages.com/p/mobile-terms-of-service.
A. Our Memorygram Text Message Program
If you provide your mobile number through a signup form or popup on our website, at checkout, or elsewhere, and check the box or otherwise indicate your consent, you are opting in to receive recurring automated text messages from Memorygram at the number you provided. These may include:
Service and transactional messages, such as order confirmations, shipping updates, and account alerts
Promotional messages, such as offers, specials, and abandoned cart reminders, if you opted in to marketing messages
Signing up is completely voluntary. Your consent is not a condition of purchase. Message frequency varies. Message and data rates may apply, and you are responsible for any charges from your wireless provider. You must be the account holder of the mobile number you provide, or have the account holder's permission to sign it up. If your mobile number changes or is reassigned, please let us know so we can update our records.
To stop receiving messages, reply STOP to any message, or text STOP to +1 (877) 550-6199. You will receive a single confirmation message and then no further messages. For help, reply HELP or text HELP to +1 (877) 550-6199, or email hello@memorygram.com.
We keep a record of your opt-in and any opt-out request so we can honor your choice and demonstrate compliance with applicable law.
B. FamilyDial
When you use FamilyDial, you are asking us to send messages or calls to your loved ones on your behalf.
Each message includes a "Reply STOP" option for the recipient.
By adding a recipient, you confirm that you have that person's permission to contact them at the number you provided, and that the number belongs to them. You are responsible for the recipients you add and the content you schedule.
9. Email Communications
Transactional emails (e.g., confirmations, reminders, password resets) are sent automatically. Promotional emails are sent only if you opt in. You can unsubscribe at any time via the link in the footer of any email.
We use Klaviyo to send and manage our email and text message communications.
We do not engage in third-party email or SMS marketing, and we do not rent, sell, or trade our email or text message lists.
10. Cookie and Tracking Technologies
"Cookies" are small, standard text files that help our website work. They do things like remember what's in your shopping cart or keep you logged in.
Google Analytics: We use Google Analytics to help us understand how our website is being used. This service helps us see, for example, which pages are most popular and how many visitors we get. This information helps us improve our site for our customers and does not include your name, email, or other directly identifying personal information.
Klaviyo: Our email and SMS signup forms and popups use Klaviyo technology, which may set cookies to remember whether you have already seen or completed a form and to associate your website activity with your subscriber profile.
Trustpilot: Pages that display customer reviews may include widgets from Trustpilot, which can set their own cookies to support widget functionality and measure engagement with the reviews shown. Trustpilot's use of this information is governed by their own privacy policy.
Marketing and Advertising Pixels: We use pixels and similar tracking technologies from advertising and analytics services on our website. These currently include Meta (Facebook and Instagram), Google Ads, TikTok, Snapchat, and AppLovin, and may include other advertising and analytics services we work with from time to time. These technologies allow us to measure ad performance, understand which ads lead to purchases, and show relevant ads to people who have visited our site. Each of these partners processes the data under their own privacy policy. You can opt out. See Section 12.
Affiliate Links: Sometimes we may recommend a product. If you click a link and buy it, we might get a small commission. This doesn't cost you anything, and it doesn't let us see your data on that other site.
Third-Party Sites: Our website may link to sites we do not operate. We are not responsible for the privacy practices or content of those sites.
11. How Long We Keep Your Information
We only keep your information for as long as we need it for its intended purpose, or as long as the law requires.
Order and Tax Info: We keep records of sales for 7 years, as required by law.
Account Information: We keep your account information as long as your account is active. If you delete your account, we remove your personal information from our active systems promptly, generally within 30 days. Limited copies may remain in encrypted backups for a short period until those backups expire on their normal cycle, and we retain what we are required to keep for tax, accounting, fraud prevention, or legal purposes.
Your Content (Stories, Audio for QR Codes): To ensure the QR codes in your physical products continue to work, we must host the associated audio and story files. We retain this content as long as your account is active. This content is removed on the same schedule described above when you delete your account.
Voice, Fingerprint, and Similar Information: Retained as described in Section 7.
Text Message Subscriptions: We keep your mobile number and your opt-in record for as long as you are subscribed. If you opt out, we retain a limited record of your number and your opt-out so that we can make sure you are not contacted again.
FamilyDial Logs: We do not retain the content of FamilyDial calls or messages after the communication is delivered. Our telecommunications providers may retain limited delivery records, such as time and destination number, as required for network operations, billing, abuse prevention, and legal compliance.
12. Your Rights and Choices
You have control over your data.
You can request access to, correction of, or deletion of your personal data by emailing us at hello@memorygram.com. We may need to verify your identity before acting on a request, and some requests may be limited by law.
You can opt out of any communications. For email, use the unsubscribe link in any message. For text messages, reply STOP to any message or text STOP to +1 (877) 550-6199.
We will not discriminate against you for exercising any of these rights.
Opt-Out of Targeted Advertising and Data Sharing
If you live in California, Texas, Colorado, Connecticut, Virginia, or certain other states, you have the right to opt out of targeted advertising and the sharing or "sale" of your personal information for advertising purposes.
To opt out with Memorygram, email us at hello@memorygram.com with the subject line "Opt Out of Advertising." We will take reasonable steps to stop sharing your information with our advertising partners, including removing you from our advertising audience lists where possible.
You can also opt out directly with the advertising platforms we use. Links for our main partners are below. Because our partners can change over time, this list may not be complete. Most platforms offer ad personalization controls in their account privacy settings, and the industry-wide tools at the bottom cover many partners at once.

13. Data Security
We take the security of your memories seriously. We use reasonable, industry-standard safeguards like encryption and secure hosting to protect your information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security, but we are committed to protecting what you entrust to us.
14. International Data Transfers
We are based in the United States. Our services and operations are hosted in the U.S. If you are located outside the U.S., please be aware that your data will be transferred to, processed, and stored in the United States.
For EU/EEA users, we rely on Standard Contractual Clauses (SCCs) approved by the European Commission for data transfers to the U.S.
15. Children's Privacy
Our services are not intended for children under 13, and we do not knowingly collect personal information from children. If we discover we have collected information from a child, we will promptly delete it. Our text message program is intended for users 18 and older.
16. Disputes
Any dispute relating to this Privacy Policy or your use of our services is governed by the dispute resolution provisions of our Terms of Service, available at https://checkout.memorygram.com/policies/terms-of-service, which include an agreement to arbitrate and a waiver of class actions.
17. Updates to This Policy
We may revise this policy at any time. We will notify users via email or a notice on our website of material changes. Continued use of our services after any changes constitutes acceptance.
